Introduction
These Terms and Conditions (the “Terms”) represent a binding legal agreement between Traventure Club (“the Company”) and its clients (“Participants”). Acceptance of these Terms is mandatory for participation in any trip organised by the Company.
General Terms
- CNIC Requirement: All Participants must possess and carry their original National Identity Card (CNIC) at all times during the trip. This is a non-negotiable security and identification measure.
- Liability for Personal Belongings: The Company disclaims all liability for the loss or damage of personal belongings. Participants are advised to secure comprehensive personal travel insurance to cover potential losses.
Safety and Risk Acknowledgment
- Safety Commitment: The Company adheres to the highest safety standards. Nonetheless, Participants must acknowledge the inherent risks in adventure/outdoor activities.
- Insurance Mandate: It is strongly recommended, and in some cases may be required, that Participants obtain comprehensive travel insurance covering personal injury, medical emergencies, trip cancellation, and loss or damage to personal belongings.
Itinerary and Trip Changes
- Alterations Policy: The Company reserves the right to alter trip itineraries due to external factors beyond its control. Participants will be promptly notified of any significant changes requiring their consent.
Financial Terms
- Dynamic Pricing: Trip costs are subject to change in response to external economic factors, including but not limited to, fuel price fluctuations. Participants will be informed of any pricing adjustments as soon as practicable.
Data Usage and Privacy
- Data Collection and Usage: Personal data collected by the Company will be used for communication and marketing purposes, in strict adherence to applicable data protection laws, including GDPR.
- Opt-Out Policy: Participants may opt-out of marketing communications at any time in accordance with data privacy regulations.
Third-Party Services
- Third-Party Reliability: While the Company selects third-party service providers with diligence, it does not bear liability for their actions or inactions.
Cancellation Policy
- Cancellation by 3Musafir: Full refunds for cancellations made by the Company before departure; partial refunds (excluding non-recoverable costs) for cancellations made during the trip.
- Cancellation by Participant: A tiered refund policy applies, dependent on the notice period. Administrative fees may be applied to all cancellations.
Natural Calamities
- Force Majeure Clause: The Company is not liable for disruptions due to natural calamities. Efforts to assist in alternative arrangements will be made, but no guarantees can be offered.
Refund Process
- Refund Procedure: Refund requests must be submitted through a formalised process, with refunds typically processed within 30 days.
Compliance with Laws
- Jurisdictional Compliance: All trips are conducted in compliance with the laws of Pakistan and the respective destination countries.
Emergency Procedures
- Emergency Contact Details: Comprehensive emergency contact information will be provided to all Participants.
Feedback and Complaints
- Feedback System: A structured mechanism for feedback and complaints ensures timely and fair resolution.
Special Needs and Accessibility
- Accommodation of Special Needs: Participants with special needs are encouraged to communicate these requirements well in advance.
Minor Participants
- Minors Policy: Participants under 18 years must have explicit parental or guardian consent.
Legal Compliance and Dispute Resolution
- Jurisdiction and Dispute Resolution: Disputes will be resolved under Pakistani law, with a commitment to fairness and transparency.
Amendment of Terms
- Amendment Rights: The Company reserves the right to amend these Terms, with due notice provided to Participants.
Intellectual Property and Media Content
- Rights to Media Content: All photographs, videos, or other media captured during trips by the Company’s staff or authorised representatives are considered proprietary content of Traventure Club. The Company reserves the right to use such media for marketing, promotional activities, and other lawful purposes. Participation in a trip implies granting the Company a perpetual, royalty-free licence to use this media worldwide.
- Participant Media: Participants are welcome to capture their own media during trips. However, media that includes the Company’s branding, staff, or identifiable trip elements should not be commercially used without the Company’s explicit consent.
- Privacy Considerations: In utilising any media content, the Company endeavours to be mindful of Participants’ privacy. Where feasible and aligned with prevailing legal standards, efforts are made to manage the use of images or recordings that are personally identifiable.
Acknowledgment and Acceptance
By booking a trip with Traventure Club, Participants acknowledge their understanding and agreement to these Terms. Legal advice is recommended for any uncertainties. Participation signifies unconditional acceptance of these Terms and Conditions.
